On July 28, 2015 the Dutch Government published the English text of the Agreement between the Kingdom of the Netherlands, in respect of Aruba, and the Czech Republic for the exchange of information on tax matters (hereafter: the TIEA), which was signed in the Hague on June 29, 2015. Although signed, the TIEA has not yet entered into force. For the TIEA to enter into force, the respective ratification procedures have to have been finalized in both countries.

 

Paragraph 1 of Article 3 of the TIEA states the following:

The taxes which are the subject of this Agreement are in the Czech Republic existing taxes of every kind and description and in Aruba existing taxes of every kind and description, including excise duties.

 

Paragraph 2 of Article 3 of the TIEA arranges that the Agreement shall also apply to any identical taxes imposed after the date of signature of the Agreement in addition to or in place of the existing taxes. Furthermore this paragraph arranges that the Agreement shall also apply to any substantially similar taxes imposed after the date of signature of the Agreement in addition to or in place of the existing taxes if the competent authorities of the Contracting Parties so agree. Furthermore, the taxes covered may be expanded or modified by mutual agreement of the Contracting Parties in the form of an exchange of letters.

 

Article 5 of the TIEA contains regulations regarding the Exchange of Information upon Request, Article 6 of the TIEA provides for the possibility to Spontaneously Exchange Information, Article 7 contains regulations regarding the Possibility of Conducting Tax Examinations Abroad, Article 8 contains regulations regarding the Possibility of Declining a Request and Article 12 contains regulations regarding a Mutual Agreement Procedure.
