On April 14, 2016 the Dutch Ministry of Finance published an Agenda (in Dutch) as well as some interesting documents for the Eurogroup and the informal ECOFIN meetings which will take place on April 22 -23, 2016.

 

The documents include a.o. a letter of the Dutch Minister of Finance to the European Commission proposing to put the Panama Papers on the informal ECOFIN meeting. An other document that might be very interesting for tax professionals is the “Presidency note on VAT Fraud”.  The presidency note starts with providing a high level summary of the European Commissions Action Plan on VAT that was presented on April 7, 2016 (see our article from April 7, 2016 for more information). Subsequently it touches on subjects like: VAT Fraud, VAT fraud detection through IT systems at EU level and which steps are needed to improve the existing system?

 

Subsequently the Presidency note on VAT Fraud proposes the following 3 issues for the discussion:

1.     In the last years we have made huge progress in direct taxation on the automatic exchange of information between tax authorities, like the recent agreement on DAC4 in the March ECOFIN. Do you agree that we should follow the same path in the fight against VAT fraud?

2.     Are you prepared – the coming months - to identify the necessary preconditions for your Member State, that have to be fulfilled and included in the proposal for you to join the use of TNA?

3.     Can we make the commitment that, within a year after the launch of the TNA proposal by the Commission, we will decide at ECOFIN level to start automatic exchange of this targeted fraud information?
